Introduction & Acceptance
These Terms of Service (“Terms”) govern your use of OptiPlate Health operated by OptiPlateHealth. By creating an account, purchasing a plan, or using the service you agree to these Terms, our Privacy Policy, and Refund Policy.
If you do not agree, do not use the service.
1. Service Description
We provide algorithmically generated, personalized nutrition plans for general wellness support. This is not medical care, diagnosis, or treatment.
2. Important Disclaimer
The content is not professional advice, medical guidance, or dietary counseling. It is for informational and educational purposes only. Consult a qualified healthcare professional or registered dietitian before making significant changes to your diet. You accept responsibility for ensuring any plan is suitable for you.
Our plans are produced by an algorithm, not by licensed professionals. We do not diagnose, treat, cure, or prevent any condition. You are responsible for consulting a qualified professional before making changes to your diet, exercise routine, or any existing care plan.
3. Account & User Obligations
You are responsible for account security and all activity under your account. Do not share credentials. You must provide accurate intake information; incorrect data may produce unsuitable plans.
4. Allergies and Food Safety
Plans are generated from the data you provide. You must verify every ingredient and label before consumption. We cannot guarantee absence of allergens, cross-contamination, or suitability for medical conditions.
5. Payments, Lemon Squeezy & Access
Payments are processed by Lemon Squeezy (Lemon Squeezy, LLC). Depending on your location, Lemon Squeezy may act as merchant of record, meaning they may appear on your card statement and handle VAT/sales tax where applicable. Their buyer terms apply to the checkout: lemonsqueezy.com/buyer-terms.
After successful payment you receive access to complete the intake form and receive your digital plan. Prices and plan durations are shown at checkout before you pay.
6. Right of Withdrawal (EU Consumers)
If you are a consumer in the EU, you generally have a 14-day right to withdraw. By choosing immediate delivery of the digital plan and affirmatively acknowledging at checkout (checkbox), you request immediate performance and waive the withdrawal right once the plan is delivered. The checkout must record the timestamp and IP of the acknowledgement.
7. Refunds
Refunds are governed by our Refund Policy.
8. Accessibility and Usability
We want everyone to be able to use our site. If you have trouble accessing or using any part of it, please let us know at [email protected]. We ask that you give us 30 days to address any accessibility issue before taking formal action. We want to make this work for you.
9. Limitation of Liability
The service is provided "as is". To the maximum extent permitted by law our aggregate liability is limited to the greater of the amount you paid in the prior 12 months or $100.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- gross negligence or willful misconduct;
- any other liability that cannot be excluded under applicable law.
The service is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, error-free, or that any generated content will be accurate or suitable for your needs. To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the service.
10. Indemnification
You indemnify us for claims arising from your use of generated plans or any violation of these Terms.
You agree to hold us harmless from claims arising from your use of the service, your violation of these Terms, or any harm to a third party related to your use of the plans or meals we generate.
11. Dispute Resolution & Governing Law
Seller: OptiPlateHealth, based in Poland.
EU/UK consumers: Nothing in these Terms limits mandatory consumer protections under the laws of your country of residence (including Poland and other EU member states). You may bring claims before the courts of your place of residence where permitted by law. You may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
Other users: To the extent permitted by applicable law, these Terms are governed by the laws of Poland without regard to conflict-of-law rules, and disputes shall be resolved in the courts of competent jurisdiction for the seller’s registered place of business, unless mandatory local law requires otherwise.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via the service or email before they take effect, and continued use after notice constitutes acceptance. You may terminate your account if you disagree with a change.
13. Data & Privacy
Our Privacy Policy explains how we process your data. We have DPAs with third-party processors; contact us for copies.
14. Automated Planning & Human Review
Meal plans are generated through automated systems that process the inputs you submit. Automated outputs are provided for educational and informational planning support and may not account for all medical context.
You may request human review of generated output by contacting [email protected]. Human review requests are handled manually by customer support and may require additional clarification from you.
15. User Acknowledgement
By using the service, you confirm all of the following:
- The service is non-medical lifestyle guidance and support.
- Content is generated with automated systems (AI-assisted workflows).
- You remain responsible for personal nutrition decisions and label checks.
- You will seek licensed medical advice for diagnosis or treatment needs.
